Former IMPD cop says hes innocent

INDIANAPOLIS (WISH) - A former IMPD officer accused of arson appeared in a Marion County court room Thursday morning.




Jesse Russell Junior says he is innocent.

In the court room, Russell was officially charged with 3 counts of arson as a B class felony, 3 counts of arson as a D class felony, and 1 count of criminal mischief as a D class felony.

The court paperwork that lists the allegations against Russell includes evidence that links him to the scenes of several fires. Talk of this evidence has his lawyers up in arms. They say they've even filed a motion addressing pre-trial publicity.

"We don't try cases using probable cause affidavits, we present evidence in court not over in the 6th floor media room, said Ralph Staples, lawyer for Russell.

Russell's lawyer is talking about the recent news conferences held by Marion County Prosecutor Carl Brizzi.

When 24-Hour News 8 asked Brizzi about the motion addressing pre-trial publicity he said, I dont know anything about it.

Russell is accused of being on the scene of all the fires he is accused of setting.

As far as I know it was good police work, said Jeffrey Mendes, attorney for Russell.

Jesse Russell Jr. is expected back in court July 20, 2010.

If convicted Russell could spend up to 30 years in prison.
